Official Rules and Regulations

The following rules and requirements (the “Official Rules”) govern the PacTour Sweepstakes (the “Sweepstakes”):

NO PURCHASE NECESSARY. VOID WHERE PROHIBITED BY LAW.

1. TO ENTER: Text “pactour” to 39668 to enter from your mobile phone. The Sweepstakes runs from September 15, 2009 through November 30, 2009 (the "Promotion Period"). Entries must be submitted by 11:59 p.m. Pacific Time on November 30, 2009 to be included in the final drawing. Open only to legal U.S. residents who, as of October 10, 2008, are at least 13 years of age. If you are under 18 years of age, you must have your parent or guardian’s permission before providing personal information. Your personal information will be used in accordance with the Website's Privacy Policy. Fuel TV and Pacific Sunwear Stores Corp. (collectively, the “Promotion Entities”) may utilize your personal information based on which opt-in(s) you have selected to receive future e-mail or text messages. All entries become the property of the Promotion Entities. Entries will be deemed as made by the authorized account holder of the telephone number or e-mail address submitted at the time of entry. The authorized account holder is the natural person who is assigned to the e-mail address or telephone number by an Internet access provider, online service provider, mobile service provider or other organization that is responsible for assigning email addresses, domains, or phone numbers associated with the submitted information.  No mechanically reproduced entries will be accepted. Limit one entry per person, per e-mail address or mobile number, which is valid for the entire Promotion Period. The Promotion Entities are not responsible for any computer system, hardware, software or program malfunctions or for other errors, failures, or delays in computer transmissions, network connections or carrier connections that are human or technical in nature.

2. DRAWING: One (1) grand prize winner, one (1) first prize winner, one (1) second prize winner, will be selected by random drawing conducted by the Promotion Entities. from all eligible entries received within the Promotion Period. Eligible entries are entries received in completion during the Promotion Period and that otherwise meet the requirements described in these Rules and Regulations. One drawing will be held on or about December 1st, 2009. All drawings are final and binding on all matters related to the Sweepstakes. The winner does not need to be present at the drawing, and will be notified by e-mail or phone within 48 hours of their name being drawn. Upon notification, the winner must claim their prize by e-mail or by the telephone number provided. If a given winner does not respond within seven (7) days of initial notification, an alternate winner will be selected at random from among remaining eligible entries.

3. PRIZES: The following prizes will be awarded: One (1) Grand Prize: Airfare, Hotel, and Transportation to Anaheim, CA.  VIP tickets to the PacTour Finale on 12/20, $1,000 PacSun Shopping Spree with Saosin. The grand prize has an Approximate Retail Value (“ARV”) of $3,000. One (1) first prize: $500 PacSun Shopping Spree. The first prize has an Approximate Retail Value (“ARV”) of $500. One (1) second prizes: One PacTour gift pack (A signed t-shirt and cd from Saosin, Innerpartystem, P.O.S. and Eye Alaska). The second prize has an Approximate Retail Value (“ARV”) of $140.00. The prize is not transferable and may not be redeemed for cash by winner. Winner will be required to sign and return a liability/publicity release and any other documents that the Promotion Entities requests prior to delivery of the prize. The difference between any stated value and actual value will not be awarded to the winner. Any tax on prizes and all expenses not expressly specified herein are the sole responsibility of the winners.

4. LIMIT ONE PRIZE PER HOUSEHOLD OR FAMILY: No prize substitutions or cash redemption shall be permitted except as provided herein or at the Promotion Entities’ sole discretion. Prizes are not transferable. The Promotion Entities reserve the right to substitute prizes of equal or greater value should featured prizes become unavailable.

5. ELIGIBILITY:  The Sweepstakes is open only to legal U.S. residents who as of September 15, 2009 are at least 13 years of age. If a winner is a minor in his/her jurisdiction of residence, the prize may be awarded in the name of, or to, the winner’s parent/legal guardian who must execute all documents and agree to all obligations and undertakings of the winner, both on behalf of himself/herself and the winner, or prize may be forfeited and awarded to an alternate winner. Employees, officers and representatives of the Promotion Entities, as well as the immediate family (spouse, parents, siblings and children) and household members of each such employee are not eligible. Prior to acceptance, the winner must sign an Affidavit of Eligibility and Liability/Publicity Release that must be returned along with valid proof of age within seven (7) days or an alternate winner may be chosen.

6. GENERAL: Each person who participates in the Sweepstakes fully and unconditionally agrees to comply with and abide by these Official Rules and the decisions of the Promotion Entities, which shall be final and binding in all respects. Winner hereby releases the Promotion Entities from any and all claims, liability, loss or damage arising out of or in connection with the awarding, receipt, possession and/or use or misuse of any prize or participation in any prize-related activity.  In addition, winner acknowledges that the Promotion Entities have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee, express or implied, in fact or in law, relative to the prize, including but not limited to its quality, mechanical condition or fitness for a particular purpose. By accepting a prize, winner consents to the use of his/her name, photo and/or likeness in any and all media by the Promotion Entities for advertising and promotional purposes without additional compensation, except where prohibited.  The Promotion Entities are not responsible for any: (a) telephone, computer, or network malfunction or error; (b) communication disruption related to Internet traffic, virus, bug or non-authorized intervention; or (c) damage caused by computer virus or bug, resulting in damage to any computer or cell phone from entrant’s access or the Sweepstakes Website. The Promotion Entities reserve the right, in its sole discretion, to cancel or suspend this Sweepstakes should virus, bugs or other causes beyond the Promotion Entities’ control corrupt the administration, security or proper play of the Sweepstakes. Persons found tampering with or abusing any aspect of this Sweepstakes, or whom the Promotion Entities believes to be causing malfunction, error, disruption or damage will be disqualified.

7. LIMITATION OF LIABILITY & RELEASE: By participating in the Sweepstakes, Entrants agree to indemnify and hold harmless Sweepstakes Entities (Defined as the promoters, sponsors and administrators of the Sweepstakes along with their parents or subsidiaries and each of their respective affiliates, subsidiaries, successors, assigns, employees or agents , specifically including Fuel TV, Pacific Sunwear Inc, its parents or subsidiaries and each of their respective affiliates, subsidiaries, successors, assigns, employees or agents from and against any and all injuries, losses, damages, claims and actions of any kind arising from or relating to participation in the Sweepstakes, or acceptance, possession, use, misuse or nonuse of the prize that may be awarded, including, without limitation, actual, direct, indirect, consequential, punitive, special, or other damages. Sweepstakes Entities are not responsible for printing or typographical errors in any Sweepstakes-related materials; for stolen, lost, late, misdirected, damaged, incomplete, illegible entries; or for transactions that are lost, misdirected, fail to enter into the processing system, or are processed, reported or transmitted late or incorrectly, or are lost for any reason, including, without limitation, computer, telephone, paper transfer, or human error; or for electronic, computer, or telephonic malfunction or error.
